As a storage field operator selling its services using market-based rates, KGS requests interested parties submit proposed Storage Capacity demand rates. Because not all applicable service rates are being requested at this time, other applicable rates may be mutually agreed upon prior to an award of Storage Capacity.
Based on the responses to this solicitation, KGS will evaluate information received and initiate discussions with Customers that KGS believes it may reach mutually agreeable terms in binding agreements, i.e., a Gas Storage Service Agreement (for those entities that have not already executed one) and/or a Confirmation for Gas Storage Services.
This Open Season does not obligate KGS to engage in or continue any negotiations with any Customer relating to Storage Capacity. Customers acknowledge that this solicitation of interest is subject to the negotiation and execution of mutually acceptable service and storage agreements which may be subject to board of directors, management and/or regulatory approval.
