CIG NOTICE
Colorado Interstate Gas Company, L.L.C. (“CIG”) and its customers are currently operating under the terms of a pre-filing settlement filed in Docket No. RP22-825-000. In that settlement, CIG committed to file a general rate case under section 4 of the Natural Gas Act with the Federal Energy Regulatory Commission (“FERC”) on September 30, 2026. Consistent with its practice, CIG will discuss with interested customers the possibility of developing a mutually agreeable pre-filing settlement and avoid the uncertainty and expenditure of resources associated with filing and litigating a general section 4 rate case (“CIG Pre-Filing Settlement Discussions”). Accordingly, CIG is inviting interested parties to attend an in-person meeting to be held on March 4, 2026, from 11:00 a.m. Mountain Standard Time (“MST”) until 4:00 p.m. MST at The Westin Denver International Airport, 8300 Pena Boulevard, Denver, Colorado. Sign-in will begin at 11:00 a.m. MST. Additional details will be provided later.
To maximize the chances of reaching a pre-filing settlement the parties will need to engage in an open and frank exchange of views and information. To facilitate those exchanges, the discussions, materials and information produced during the CIG Pre-Filing Settlement Discussions will need to be protected by restricting their use for settlement purposes only. As such, participation in the CIG Pre-Filing Settlement Discussions, including the access to and use of materials and information pertaining to these discussions, will be limited to individuals and their respective companies that enter into and agree to abide by the Confidentiality Acknowledgment set forth below and that execute an Access Agreement. The Access Agreement, to be executed by a duly authorized representative of an interested participant, will govern the access of the participant's authorized representative(s) to a secure website that CIG will establish to provide information to facilitate settlement discussions (“Website”). Notwithstanding the fact that no proceeding has yet been initiated for these matters at FERC, the Confidentiality Acknowledgment and Access Agreement provide that the protections afforded by Rules 601 and 602 of FERC's Rules of Practice and Procedure and any precedent on the treatment of settlement discussions, material and information will apply to the CIG Pre-Filing Settlement Discussions.
Customers interested in participating in the CIG Pre-Filing Settlement Discussions and attending the March 4th meeting should: 1) have each of its participating representatives copy and paste the Confidentiality Acknowledgement below in an e-mail stating that the representative, and the entity represented, accepts and agrees to the terms of the Confidentiality Acknowledgement, and 2) provide CIG with a list of attendees for the meeting, by March 2, 2026. Any non-attending individuals receiving information from or after the March 4th meeting (including information posted to the Website) must also send CIG an e-mail with the information required from a participating representative discussed in (1) above. The e-mails agreeing to the Confidentiality Acknowledgment and the list of attendees should be sent to Stacie Gonzalez at Stacie_Gonzalez@kindermorgan.com. Access Agreements may be obtained from Ms. Gonzalez as well.
Once CIG has received the e-mail accepting the Confidentiality Acknowledgements and the executed Access Agreement, the signing party may designate Authorized Representatives (who have individually accepted and agreed to the Confidentiality Agreement as described more fully earlier) to access and use the Website by e-mailing: the designee's name, company name, party represented, e-mail address and phone number, to Stacie Gonzalez at Stacie_Gonzalez@kindermorgan.com. CIG anticipates that the Authorized Representatives will be able to access the secure website shortly after March 4, 2026.
If you have any questions regarding the Confidentiality Acknowledgement or Access Agreement, please contact David Cain at 719-520-4534 or David_Cain@kindermorgan.com. If you have questions generally about this initiative, please contact Shelly Busby at 719-520-4657 or Shelly_Busby@kindermorgan.com or Dan Tygret at 719-520-3765 or at Daniel_Tygret@kindermorgan.com.

I will not upload, input, disclose any settlement discussions, materials or information, or otherwise make available any of the settlement discussions, information and materials to any artificial intelligence, machine-learning, large language model or similar automated system, whether operated by a third party or by me or my company (including affiliates), that uses such information for training, retention or processing outside of my or my company's direct control. I will discuss or provide the information obtained as part of these settlement discussions, and the materials and documents that a party has provided during these settlement discussions and identified as confidential, only with CIG's representatives or with someone who has agreed to this Acknowledgement as designated on a list maintained by CIG which may be obtained by sending the appropriate e-mail to Stacie Gonzalez at Stacie_Gonzalez@kindermorgan.com. Finally, I understand my participation in the discussions and receipt of materials are conditioned on my agreement and promise to abide by the confidentiality provisions of this Acknowledgement. I understand that this Acknowledgement does not preclude me from using any information legally obtained from sources other than these settlement discussions, information and documents.
